These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”, “you”) and MOZHER (“MOZHER”, “we”, “us”, “our”), governing your access to and use of the MOZHER website, mobile interfaces, digital platforms, and related services (collectively, the “Platform”).

By accessing, browsing, registering, or purchasing through the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.

1. Definitions

• Products: Plants, pots, fertilizers, medicines, tools, accessories, and related items offered for sale.
• Living Products: Plants or biological items subject to natural variation.
• Services: Consultations, setup, repotting, styling, or guidance.
• Order: A request to purchase Products or Services.
• Content: All text, images, graphics, layouts, videos, branding, and materials on the Platform.

2. Scope & Applicability

These Terms apply globally to all users, transactions, Products, and Services offered by MOZHER, regardless of location, access method, or payment type.

These Terms must be read together with our Privacy Policy, Cookie Policy, Delivery Policy, and Live Arrival Policy, which form an integral part of this agreement.

3. Eligibility & Legal Capacity

You confirm that you are at least the age of legal majority in your jurisdiction and have full legal capacity to enter into binding agreements. If acting on behalf of an entity, you confirm you are authorized to bind that entity.

4. Accounts & Security

You are responsible for maintaining accurate account information and safeguarding your login credentials. MOZHER is not liable for losses arising from unauthorized access caused by user negligence.

We reserve the right to suspend, restrict, or terminate accounts at our sole discretion.

5. Product Information & Accuracy

All Product descriptions are provided in good faith. Living Products are not standardized goods. Natural variations in size, shape, color, growth stage, and appearance are normal and expected.

Images are illustrative only and may not represent the exact Product delivered.

6. Product Representation & Image Disclaimer

6.1 Living Product Variation

All digital images, renders, and videos of Living Products are for illustrative purposes only. Variations in appearance due to biological nature, seasonality, transport, or acclimatization are normal and not considered defects.

6.2 Display & Environmental Differences

Differences may occur due to screen calibration, lighting, photography conditions, or environmental factors. MOZHER does not guarantee an exact visual match.

6.3 Styling & Props

Unless explicitly stated, decorative items, accessories, pots, stands, or props shown in images are not included in the purchase.

6.4 Branded Products & Packaging

Packaging, labeling, or branding of third-party products may change at the manufacturer’s discretion. MOZHER guarantees authenticity but not identical packaging.

6.5 No Refunds for Visual Preference

Products are not eligible for return, refund, or replacement based solely on visual mismatch, subjective expectation, or aesthetic preference when specifications are met.

7. Orders & Acceptance

Placing an Order constitutes an offer to purchase. An Order is accepted only after confirmation by MOZHER. We reserve the right to refuse or cancel any Order.

8. Pricing, Taxes & Payments

Prices are displayed in the applicable currency and may be subject to taxes or fees. Accepted payment methods may include online payments or Cash on Delivery (COD).

Repeated COD refusals may result in account restrictions.

9. Delivery & Risk Transfer

Delivery times are estimates only. Risk transfers to the customer upon delivery to the specified address. Accurate delivery information and availability are the customer’s responsibility.

10. Live Plants & Care Responsibility

Plants may experience transplant shock or temporary stress. Care instructions are guidance only. MOZHER does not guarantee survival, growth rate, flowering, or longevity.

11. Returns, Refunds & Replacements

Returns for Living Products are limited. Claims must be submitted within the timeframe specified in our Refund Policy, with clear photographic evidence.

12. Services Disclaimer

All advice or guidance is informational only and does not constitute professional, agricultural, or medical advice.

13. Right to Refuse Service or Sale

MOZHER reserves the absolute right, at its sole and unrestricted discretion, to refuse service, refuse sale, cancel orders, restrict access, or terminate accounts at any time and for any reason, including without limitation:

• Suspected fraud or abuse
• Violation of these Terms
• Operational, logistical, or supply constraints
• Repeated order refusal or non-compliance
• Behavior deemed harmful, abusive, or disruptive
• No reason at all, where permitted by law

Such refusal shall not constitute a breach of contract or give rise to liability.

14. Acceptable Use

You agree not to misuse the Platform, interfere with its operation, or exploit its Content without authorization.

15. Intellectual Property

All Content is owned by or licensed to MOZHER. Unauthorized use is strictly prohibited.

16. User Content

By submitting content, you grant MOZHER a worldwide, royalty-free license to use it. We reserve the right to remove content at our discretion.

17. Third-Party Services

We are not responsible for third-party platforms, services, or links. Use is at your own risk.

18. Limitation of Liability

To the maximum extent permitted by law, MOZHER shall not be liable for indirect or consequential damages. Total liability shall not exceed the amount paid for the Product or Service.

19. Indemnification

You agree to indemnify and hold harmless MOZHER from claims arising from misuse of the Platform or breach of these Terms.

20. Privacy & Data Protection

Use of the Platform is governed by our Privacy Policy.

21. Governing Law & Jurisdiction

These Terms are governed by the laws applicable in the jurisdiction where MOZHER operates. Disputes shall be subject to the competent courts of that jurisdiction.

22. Amendments

MOZHER may modify these Terms at any time. Continued use constitutes acceptance of the updated Terms.

23. Severability

If any provision is deemed unenforceable, the remaining provisions shall remain in full force.
